1. Acceptance of Terms
Welcome to Northumberland Events. By accessing or using our website, mobile application, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
These Terms constitute a legally binding agreement between you and Northumberland Events ("we," "our," or "us"). We reserve the right to modify these Terms at any time. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
2. Description of Services
Northumberland Events provides a platform for discovering, browsing, and managing information about local events in Northumberland County, Ontario, and surrounding areas. Our Services include:
- Event discovery and browsing functionality
- Event detail pages with location, time, and description information
- User account creation and management
- Event bookmarking and calendar export features
- Member event submission capabilities (for verified Silver members)
- Location-based event recommendations
3. User Accounts and Registration
3.1 Account Creation
To access certain features of our Services, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
3.2 Account Types
- Basic Member: Can browse events, bookmark events, and set reminders.
- Silver Member: Verified users who can submit events for admin approval, plus all Basic member features.
- Admin/Superadmin: Platform administrators with full access to manage sources, events, and users.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason we deem appropriate. You may also delete your account at any time through your profile settings.
4. User-Generated Content
4.1 Event Submissions
Silver members may submit events for publication on our platform. By submitting an event, you represent and warrant that:
- You have the right to submit the event information
- The event information is accurate, truthful, and not misleading
- The event does not violate any third-party rights or applicable laws
- You have obtained necessary permissions to use any images, logos, or content submitted
4.2 Content License
By submitting content to our Services, you grant Northumberland Events a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute the content in connection with operating and promoting our Services.
4.3 Content Moderation
We reserve the right to review, modify, or remove any user-submitted content at our discretion. All member-submitted events are subject to admin approval before publication.
5. Prohibited Conduct
You agree not to:
- Use the Services for any illegal purpose or in violation of any laws
- Submit false, misleading, or fraudulent event information
- Impersonate any person or entity or misrepresent your affiliation
- Harass, abuse, or harm other users
- Upload viruses, malware, or any malicious code
- Attempt to gain unauthorized access to our systems or user accounts
- Scrape, crawl, or use automated tools to access our Services without permission
- Interfere with or disrupt the Services or servers
- Submit spam, duplicate events, or irrelevant content
- Use the Services to promote competing event platforms
6. Intellectual Property Rights
6.1 Our Content
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are owned by Northumberland Events or its licensors and are protected by copyright, trademark, and other intellectual property laws.
6.2 Third-Party Content
Event information is aggregated from various sources and event organizers. We do not claim ownership of third-party event content. Event organizers and sources retain all rights to their content.
6.3 Trademarks
"Northumberland Events" and associated logos are trademarks of Northumberland Events. You may not use our trademarks without our prior written permission.
7. Third-Party Links and Services
Our Services may contain links to third-party websites, event pages, and services. We are not responsible for the content, accuracy, or practices of these third parties. Your use of third-party services is at your own risk and subject to their terms and privacy policies.
8. Disclaimers and Limitation of Liability
8.1 Event Information Accuracy
We aggregate event information from multiple sources and make reasonable efforts to ensure accuracy. However, we do not guarantee that event information is accurate, complete, or current. Events may be cancelled, rescheduled, or changed by organizers without notice. Always verify event details with the event organizer before attending.
8.2 Service Availability
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted, timely, secure, or error-free operation of the Services.
8.3 Limitation of Liability
To the fullest extent permitted by law, Northumberland Events shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Services.
In no event shall our total liability to you for all claims exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Northumberland Events, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit to the Services
10. Privacy
Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and share your personal information. By using the Services, you consent to our privacy practices as described in the Privacy Policy.
11. Location Services
Our Services may use your device's location to provide location-based features, such as finding nearby events. Location data is collected only with your permission and can be disabled at any time through your device settings. Location services are optional and not required to use basic features of the platform.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice or liability. We may also impose limits on certain features or restrict access to parts of the Services without notice.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
13.2 Dispute Resolution
Any disputes arising from these Terms or your use of the Services shall be resolved exclusively in the courts located in Northumberland County, Ontario. You consent to the personal jurisdiction of such courts.
13.3 Class Action Waiver
You agree that any proceedings to resolve disputes will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Northumberland Events regarding the use of the Services and supersede all prior agreements and understandings.
